Texas Alimony Lawyers

In Texas, family law courts may order both temporary and long-term alimony when there is a disparity in earnings between the husband and the wife. Long-term alimony is usually limited to three years and is only awarded in long-term marriages (those lasting 10 years or longer).

The amount of alimony (also known as spousal support or maintenance) is based on the needs of the person receiving it. The guidelines in Texas are as follows:

• Temporary alimony is paid while the divorce is pending. You can request
temporary spousal support for up to 50% of the community property earnings.

• Long-term alimony is generally 20 to 25% of the payer's earnings, though the
parties can agree to a higher amount contractually.

At the law firm of Martin & Lilly, lawyers will help you negotiate a spousal support agreement that is in your best interest. In the give and take of a marital property settlement, negotiating higher spousal support payments in place of higher can benefit both parties. Spousal support is tax deductible by the party who pays it, while child support isn't.
